Employment law regulates the relationship between employers and employees — covering employment contracts, working conditions, termination procedures, compensation rights and the collective labour law framework. Employment legislation in Türkiye is frequently updated; minimum wage, overtime limits, severance pay reform discussions and regulations concerning foreign personnel are among the areas that employers must carefully monitor. Emir Law & Consulting provides advisory and judicial representation to both employers and employees in employment law matters.
Individual Employment Law: Contracts, Termination and Compensation
Proper structuring of the employment contract prevents future disputes. We provide contract drafting and negotiation support for indefinite-term, fixed-term and project-based contracts; probation periods, non-compete and confidentiality provisions; job descriptions and flexible working arrangements. In termination processes, we provide strategic guidance to employers on the distinction between valid cause and just cause, complete fulfilment of procedural requirements and minimisation of reinstatement litigation risk.
Severance Pay, Notice Pay and Employee Claims
We conduct mediation and litigation processes on behalf of both employees and employers in relation to severance pay calculations, notice pay and annual leave entitlements; overtime, weekly rest and national holiday pay; and bonus and premium claims. Our team, which successfully represents parties in the mandatory mediation process under the Labour Courts Law No. 7036, conducts effective litigation before labour courts where settlement cannot be reached.
Foreign Personnel and Work Permits
A work permit is mandatory when employing foreign nationals in Türkiye. We advise on work permit and work permit exemption applications, extension and amendment procedures and compliance with the foreign personnel ratio rules in the company. Our team has experience in the expedient management of work permit processes for foreign experts working on SPP, construction and technology projects.
Remote Working and New Forms of Employment
Remote working (home office), which gained a statutory basis with Law No. 7244, is regulated by the provisions added to the Labour Law No. 4857. We provide employers with policy and contract support compliant with current legislation on remote working agreements, expense reimbursement, occupational health and safety obligations and data protection requirements.
Collective Labour Law and Union Relations
We provide strategic advisory to employers on union authorisation determinations, collective bargaining agreement negotiations, dispute and mediation processes and legal measures against strike and lockout decisions. Our team also provides guidance on technical matters such as industry and workplace classifications, transfer of undertaking and the implications of union membership.
