Under the Law on Foreigners and International Protection No. 6458 (LFIP), various statuses are available for foreigners wishing to reside in Türkiye. Selecting the correct residence type is of critical importance both for meeting current legal requirements and for preparing for long-term residence or citizenship timelines in the future. Emir Law & Consulting provides comprehensive support in status determination, application preparation, DGMM follow-up and appeal processes.
Types of Residence Permits
The principal residence statuses granted to foreigners in Türkiye are as follows:
- Short-Term Residence Permit: Granted for property ownership, commercial ties, tourism, health or educational purposes; typically for 1–2 years, renewable.
- Family Residence: Granted to spouses and minor children for reunification with a Turkish citizen or residence permit holder.
- Student Residence: A special status for higher education or language course students in Türkiye.
- Long-Term Residence Permit: Granted indefinitely to foreigners who have completed 8 years of uninterrupted legal residence in Türkiye; cannot be revoked except in cases of conduct contrary to public order and extended stays abroad.
- Humanitarian Residence Permit: Granted by administrative decision where voluntary return or deportation is not possible.
Long-Term Residence: The Path to Permanent Status
A long-term residence permit enables access to certain rights granted to Turkish citizens, such as property acquisition and access to education and healthcare. In calculating the 8-year uninterrupted residence period, time spent abroad may be deducted under certain conditions. Accurate calculation of the accumulated period and completeness of documentation prior to the application are of critical importance.
Blue Card: Special Status for Persons of Turkish Origin
The Blue Card is a special status granted to persons who relinquished Turkish citizenship upon acquiring citizenship of a foreign country, and to their spouses. It provides work permit exemption, treatment as a domestic national in land registry and trade registry matters, access to social security rights and entry to Türkiye without a passport. There is no requirement to reside in Türkiye.
Appeals against Rejection and Cancellation Decisions
Rejection or cancellation of a residence permit is subject to legal review through administrative appeal to the DGMM or annulment action before the Administrative Court. A stay of execution request may temporarily suspend the enforcement of the rejection decision. Since a 60-day filing period generally applies from the date of notification, swift intervention is essential.
